Harvey Weinstein Granted Hospital Transfer Ahead of Rape Retrial

Harvey Weinstein will be allowed to stay in a New York City hospital, instead of jail, during his retrial on sexual assault charges in New York City, The Associated Press reports.

Weinstein’s lawyers requested the hospital transfer earlier this week, and on Thursday night, April 17, Judge Paul Goetz approved the move. Weinstein, who was previously incarcerated at Rikers Island jail, will be allowed to stay at the prison ward at Bellevue Hospital in Manhattan.

In their request, Weinstein’s lawyers cited the “deplorable conditions” at the jail and said the disgraced producer was being “consistently mistreated for serious infections” and other ailments. Weinstein was diagnosed with chronic myeloid leukemia, a type of bone marrow cancer, in October 2024.

“Because of this mistreatment, he has been worn down considerably health-wise, and now faces the stress of trial in this condition, which may very well lead to serious health complications, even death,” his lawyer, Imran H. Ansari, wrote at the time.

Jury selection in Weinstein’s retrial began this week and is set to continue Monday, April 21. Nine jurors have been selected so far, meaning three more jurors, plus six alternates, still need to be seated.

Weinstein is being retried in New York after his 2020 conviction was overturned. The producer was originally convicted on two out of five charges against him, one for a felony sex crime, and the other for third-degree rape. The charges related to two victims: Former production assistant Miriam Haley, who accused Weinstein of assaulting her in 2006 (the sex crime charge) and actress Jessica Mann, who said Weinstein raped her in a hotel in 2013 (the rape charge).

Weinstein was sentenced to 23 years in prison, but last spring an appeals court overturned the conviction, saying that prosecutors should not have been allowed to let some of Weinstein’s other accusers, whose allegations were not related to the charges he faced, testify.

Ahead of the retrial, prosecutors brought one new sex crime charge against Weinstein, with an anonymous woman accusing him of sexually assaulting her in a Manhattan hotel room in 2006. Weinstein has pleaded not guilty to the new charge and repeatedly denied all other allegations against him.

Along with the New York case, Weinstein was also convicted of rape and sexual assault, and sentenced to 16 years in prison, in a separate California case. He’s filed an appeal in that case, as well.
